Coinbase Settles FOIA Suit with SEC Over Missing Communications

Instructions

Cryptocurrency exchange Coinbase has announced the resolution of its Freedom of Information Act (FOIA) lawsuit against the U.S. Securities and Exchange Commission (SEC). This information was conveyed by Paul Grewal, Coinbase's chief legal officer, in an opinion piece published in the Wall Street Journal. The lawsuit stemmed from Coinbase's efforts to obtain various records from the SEC, particularly text messages exchanged between former SEC Chair Gary Gensler and other agency officials.

Grewal highlighted that the SEC, despite its role in overseeing corporate record-keeping, claimed to have lost these crucial communications due to a system that "automatically wiped" certain data. The terms of the settlement mandate that the SEC will compensate Coinbase with $150,000 and, significantly, implement revisions to its record-retention policies. This resolution marks a notable outcome for Coinbase, which had previously initiated legal action against the SEC and the Federal Deposit Insurance Corp. in 2024, alleging a concerted regulatory push to suppress crypto-related businesses. Coinbase's earlier suit aimed to compel the disclosure of additional communications from high-ranking SEC personnel, including Gensler.

Coinbase has experienced various successes in its interactions with the SEC, particularly during the Trump administration, which included the dismissal of a significant lawsuit initiated by the regulator under President Joe Biden. The company has also actively supported legislative efforts, such as a stablecoin bill that successfully passed the U.S. Congress. Looking ahead, Reuters has indicated that the SEC is contemplating more crypto-friendly regulations, potentially including provisions that would enable cryptocurrency companies to offer blockchain-based stocks. This evolving regulatory landscape suggests a potential shift towards greater integration of digital assets within traditional financial structures, fostering innovation while balancing investor protection.
